These rental terms apply to the rental contract between the rental company and you as the renter if the rental company has expressly adopted them on Rentlo. The rental company is the company named in the "Contracting party" booking step and in your booking confirmation. Rentlo is not a party to the rental contract.
Version: mm-2026-10
1. Subject of the contract
(1) The rental company provides you with the booked vehicle for the booked period. The information in the listing and in the booking confirmation is decisive, in particular the vehicle, rental period, pick-up and return location, included kilometres, excess, protection package, deposit, extras and price.
(2) The rental company may provide an equivalent or higher-quality vehicle of the same category if the booked vehicle is not available for reasons for which it is not responsible and you agree. If you do not agree, you receive all amounts already paid back.
2. Drivers and requirements
(1) The vehicle may only be driven by you and the additional drivers named in the booking.
(2) At handover, every driver must present a valid driving licence sufficient for the vehicle and an official photo ID in the original and meet the minimum age and years of holding a licence stated in the listing.
(3) If a driver cannot prove these requirements at handover, the rental company may refuse the handover. The cancellation rules under no. 10 then apply as for a cancellation on the day the rental starts.
3. Price and payment
(1) The total price shown at the time of booking applies. It includes VAT, insofar as the rental company shows it, and all unavoidable costs.
(2) You pay via Rentlo, which receives payments in the name and for the account of the rental company. Your payment to Rentlo discharges your payment obligation in that amount.
(3) The rental company charges costs that only arise during the rental (for example excess kilometres, missing fuel or charge, special cleaning, late return) at the rates stated in the listing. If no rate is stated there, it may only charge the costs actually incurred and proven.
4. Deposit
(1) If the rental company requires a deposit, the amount and type stated in the listing apply (online via Rentlo or on site).
(2) The deposit secures the rental company's claims under this rental contract. The rental company releases it without undue delay after the return, insofar as there are no claims. It justifies any retention with the return report and receipts.
5. Pick-up and return
(1) At pick-up and return, the rental company and the renter jointly prepare a report with the mileage, fuel or battery level, existing damage and photos, preferably in the Rentlo app.
(2) You return the vehicle at the agreed time at the agreed place with the fuel or battery level at handover and in a clean condition, apart from normal soiling.
(3) If you return the vehicle more than 60 minutes late, the rental company may charge the daily price stated in the listing for each additional day started, at most the damage it actually suffers. You remain free to prove a lower damage.
6. Use of the vehicle
(1) You treat the vehicle with care, observe the operating instructions and traffic rules and secure it against theft.
(2) Unless the listing permits otherwise, the following are not permitted:
- races, driving on race tracks, driving safety training and off-road driving,
- subletting or handing the vehicle over to drivers other than those named,
- commercial transport of passengers or goods,
- driving under the influence of alcohol, drugs or medication that impair the ability to drive,
- journeys abroad if the listing does not permit them or you have not booked them,
- smoking in the vehicle and transporting animals without the rental company's consent,
- transporting dangerous substances and overloading the vehicle.
7. Kilometres
The kilometres stated in the listing are included in the price. The rental company charges excess kilometres at the rate stated in the listing.
8. Accident, damage, breakdown and theft
(1) In the event of an accident, damage, breakdown or theft, you inform the rental company immediately via the chat in the Rentlo app or by phone. In the event of an accident involving personal injury or damage to third-party property and in the event of theft, you also notify the police.
(2) You do not make any acknowledgement of liability and document the accident, if possible, with photos, names and addresses of those involved and witnesses.
(3) You only commission repairs over 100 euros with the rental company's consent, unless they are urgently necessary to continue the journey or to avert a danger.
9. Liability
(1) The vehicle has third-party liability insurance in accordance with the statutory provisions. Whether and to what extent fully comprehensive or partial insurance or a contractual reduction of liability (protection package) exists is stated in the listing and in the booking confirmation.
(2) You are liable for damage to the vehicle during the rental period up to the amount of the agreed excess, insofar as a reduction of liability exists. Without a reduction of liability, you are liable in accordance with the statutory provisions.
(3) The reduction of liability does not apply if you or a driver caused the damage intentionally. In the event of gross negligence, the rental company may reduce the reduction of liability in proportion to the severity of the fault. This also applies in the event of a violation of no. 6(2) or no. 8, insofar as the violation caused the damage or its extent.
(4) You are liable for traffic and parking offences, tolls and towing costs during the rental period. The rental company may charge a fee in the amount stated in the listing for processing an official enquiry, at most the actual expense.
(5) The rental company is liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act. In the event of slight negligence, it is only liable for the breach of essential contractual obligations and limited to the typical, foreseeable damage.
10. Cancellation
(1) If you cancel a paid booking, the cancellation rules shown in the listing and before booking apply. They determine what share of the rental price is refunded. You remain free to prove that the rental company suffered no damage or a lower damage.
(2) If the rental company cancels or cannot provide the vehicle, you receive all amounts paid back. Further statutory claims remain unaffected.
(3) There is no statutory right of withdrawal for this rental contract (section 312g(2) no. 9 BGB).
11. Data
The rental company processes your data for the performance of this contract under its own responsibility. Which data Rentlo transmits to the rental company is set out in Rentlo's privacy policy.
12. Final provisions
(1) German law applies. If you are a consumer, the mandatory provisions of the state in which you have your habitual residence remain unaffected.
(2) Deviating agreements in the listing or in text form between you and the rental company take precedence over these terms.
(3) Should a provision be invalid, the remaining provisions remain valid.
